Types of Divorce

Divorce can be classified in different ways. But below are the most common types of divorce.

a. No-fault Divorce

This type of divorce is simply satisfied through court by the mere assertion of the couple that the marriage has broken down. The judicial officer will not require any proof of fault or whatsoever. As long as the two parties agree that there is no hope for their marriage and there is no reason to continue with such a relationship; the judicial officer will grant the couple their wishes.

b. At-Fault Divorce

Some countries will only accept the petition for divorce if the judicial officer sees sufficient ground for divorce. Nevertheless, this type of divorce will waste a lot of money on both parties especially if one of them believes that it is the other party’s fault why the marriage has broken down.

c. Summary Divorce

This is available in certain jurisdictions the moment one of the following eligibility requirements is met:

1. marriage which is less than five years

2. no children amidst the length of marriage

3. marital property which is less than $35,000

4. no real property on mortgage

d. Uncontested Divorce

This is quite similar with no-fault divorce and is the main type of divorce used by 95% of divorcees in the United States. Both parties agree that divorce is the best option and they have also set up an agreement with regards to the handling of children, support issues and property. Most of the time, both parties already engaged in pre-divorce meeting and only needs the seal of the judge to have it legal.

e. Collaborative Divorce

This is successfully accomplished with the aid of well trained lawyers especially when the parties involve do not wish to discuss matters on their ends alone. This is preferred by couples because it saves them from financial and emotional stress which is always present in divorce settlements.

f. Electronic Divorce

This is a specific type of divorce honored only in a few countries like Portugal. Under this situation, a married couple can file their petition for divorce electronically and they may receive it within an hour after providing proof that there are no complicated issues that goes with their request like children, real property and the like.
